Terms of Service

Please read these terms carefully before using ColorRestore's photo restoration services.

Acceptance of Terms

By accessing and using ColorRestore ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our service.

ColorRestore is a tool created by The Pixverse Co. These Terms of Service ("Terms") govern your access to and use of ColorRestore's AI-powered photo restoration and colorization services. We reserve the right to modify these terms at any time, and such modifications shall be effective immediately upon posting.

References to "ColorRestore," "we," "us," or "our" in these Terms refer to The Pixverse Co. and its ColorRestore service. The Pixverse Co. is the operator and service provider of ColorRestore.

Age Restrictions: You must be at least 18 years old to use this Service, or if you are under 18, you must have the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent and warrant that you meet these age requirements.

Privacy and Data Protection

Your privacy is important to us. We process your uploaded images securely and do not use them for training our AI models or marketing purposes. Images are processed and stored temporarily to provide you with restoration services.

We implement industry-standard security measures to protect your data. However, you acknowledge that no method of transmission over the internet or electronic storage is 100% secure.

By using our service, you grant ColorRestore a limited, non-exclusive license to process your images solely for the purpose of providing restoration services. You retain all ownership rights to your original and restored images.

User Responsibilities

You are responsible for ensuring that you have the legal right to upload, process, and restore any images you submit through our service. You may not upload images that:

  • Infringe upon any copyright, trademark, or intellectual property rights
  • Contain illegal, harmful, or offensive content
  • Violate any applicable laws or regulations
  • Include content that you do not have permission to use
  • You may not use the Service to create, modify, or distribute images that impersonate, misrepresent, or alter another person’s likeness without consent. ColorRestore does not generate synthetic or deepfake content.
  • By uploading any image, you confirm that you either own the image or have explicit permission from the rights holder or depicted individual(s) to process it using the Service.

Prohibited Uses:

  • Face swaps, deepfakes, or synthetic likeness generation.
  • Uploading images without consent/rights or that violate law or third-party rights.
  • Bypassing, probing, or disrupting our security, rate limits, or infrastructure.
  • Reselling, sublicensing, or offering the Service as part of a marketplace/platform.

Account Security: You are solely responsible for maintaining the confidentiality of any account credentials, payment information, or access methods associated with your use of the Service. You agree to notify us immediately of any unauthorized access or use of your account or any other breach of security.

You agree to indemnify, defend, and hold harmless The Pixverse Co., ColorRestore, their affiliates, subsidiaries, parent companies, officers, directors, employees, agents, contractors, licensors, and service providers from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, debt, expenses (including but not limited to reasonable attorney's fees and court costs), and settlements arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property, privacy, or publicity rights; (d) your upload of images that you do not have the legal right to use, modify, or restore; (e) any claims that restored images created through our Service infringe upon third-party rights; (f) your use or distribution of restored images in violation of applicable laws or regulations; or (g) any damage, loss, or claim resulting from your reliance on restoration results.

Service Availability and Limitations

We strive to provide reliable service but do not guarantee that our service will be uninterrupted, secure, or error-free. The Service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances.

Our AI restoration technology provides results based on algorithmic analysis and historical data. While we aim for high-quality results, the restoration outcome may vary based on the condition of your original image, and we cannot guarantee specific results. You acknowledge that AI-generated restoration results may contain inaccuracies, artifacts, or may not meet your expectations, and ColorRestore shall not be liable for any dissatisfaction with restoration results.

ColorRestore reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

Payment and Refund Policy

Payment is required before processing your images. Our pricing is simple: $1.00 per photo. Payment can be made before processing to receive images without watermark, or you can try a free preview with watermark first. We reserve the right to modify our pricing at any time, with or without notice. Price changes will not affect orders already placed or in progress.

All sales are final. Refunds may be considered on a case-by-case basis for technical issues that prevent image processing entirely, subject to our sole discretion and review. Refund requests must be submitted within 7 days of purchase. Refunds will NOT be provided for:

  • Dissatisfaction with restoration quality or results
  • AI-generated results that do not meet expectations
  • Color accuracy or historical authenticity concerns
  • Successful processing where images were successfully restored (regardless of quality)
  • User error, including uploading incorrect images
  • Change of mind after purchase

If a refund is approved, it will be processed to the original payment method within 5-10 business days. ColorRestore reserves the right to deny any refund request at its sole discretion.


Payment Information: Payments are securely processed through PayPal, a PCI-compliant third-party payment processor. We do not store or have access to your full payment details, including credit card numbers or bank account information. All payment information is handled directly by PayPal in accordance with their privacy policy and terms of service.

Invoices and Receipts: All invoices, receipts, and payment confirmations will be issued in the name of The Pixverse Co. You will receive payment confirmation via email from PayPal, and any invoices or receipts will clearly identify The Pixverse Co. as the service provider.

Taxes and similar charges may be calculated and collected at checkout where required by law. In the event of a chargeback or payment dispute, you authorize us and our payment processor to recover amounts owed as permitted by applicable card-network rules and law.

We do not offer subscriptions or free trials. Each purchase authorizes a one-time processing of the specified images.

Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, trademarks, service marks, software, algorithms, AI models, user interfaces, and the overall design and structure of the Service, are the exclusive property of The Pixverse Co. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The "ColorRestore" name and logo are trademarks of The Pixverse Co.

You retain all ownership rights to your original images. Restored images created through our service are provided to you for personal, non-commercial use. Commercial use of restored images, including but not limited to sale, licensing, advertising, marketing, or any commercial distribution, may require additional licensing arrangements with The Pixverse Co. You may not claim ownership or authorship of the AI technology, algorithms, or processes used to create restored images.

DMCA Copyright Policy: The Pixverse Co. respects the intellectual property rights of others. If you believe that any content on our Service infringes your copyright, please contact us with a DMCA takedown notice containing: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; (d) a statement of good faith belief; (e) a statement of accuracy; and (f) your signature. We will respond to valid DMCA notices in accordance with applicable law.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

ColorRestore does not warrant that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components. We do not guarantee the accuracy, quality, completeness, or suitability of any restoration results generated by our AI technology.

You acknowledge and agree that:

  • Restoration results are generated by automated AI systems and may vary in quality, accuracy, or completeness
  • We do not guarantee specific restoration outcomes, color accuracy, or historical authenticity
  • The Service may not be suitable for all types of images or restoration needs
  • AI-generated results may contain inaccuracies or artifacts
  • We are not responsible for any loss or damage to your original images or data

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PIXVERSE CO., COLORRESTORE, THEIR AFFILIATES, SUBSIDIARIES, PARENT COMPANIES, AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, SUPPLIERS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenues, data, use, goodwill, or other intangible losses
  • Loss or damage to uploaded or restored images
  • Any errors, omissions, or inaccuracies in restoration results
  • Service interruptions, delays, or failures
  • Technical malfunctions, bugs, or system failures
  • Any unauthorized access to or use of your images or data
  • Any decisions made or actions taken based on restoration results
  • Any third-party claims arising from your use of the Service or restored images

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF WARRANTY, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE PIXVERSE CO. FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR THE AMOUNT YOU PAID FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE TOTAL AMOUNT YOU PAID TO THE PIXVERSE CO. IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Time Limitation for Claims: Any claim or cause of action arising out of or related to these Terms or the Service must be commenced within one (1) year after the cause of action accrues, or such claim or cause of action is forever barred.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law in your jurisdiction.

Jurisdiction, Governing Law, and Local Regulations

United States: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware. Nothing in these Terms affects your rights as a consumer under applicable United States federal or state consumer protection laws.

Dispute Resolution and Arbitration: For users located in the United States, any dispute, controversy, or claim arising out of or relating to these Terms, the Service, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules, except as modified by this agreement. The arbitration shall be conducted in Delaware. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. YOU AND THE PIXVERSE CO. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If this arbitration provision is found to be unenforceable, then the entirety of this arbitration section shall be null and void, and the parties agree that any disputes shall be resolved in the courts specified above.

European Union (EU) and European Economic Area (EEA): If you are located in the EU or EEA, these Terms are subject to the mandatory provisions of the law of your country of residence. Certain liability limitations may not apply to consumers in the EU/EEA, and you may have additional rights under EU consumer protection laws, including but not limited to:

  • Right to withdraw from distance contracts under Directive 2011/83/EU
  • Right to remedies for non-conformity under Directive (EU) 2019/771
  • Data protection rights under the General Data Protection Regulation (GDPR)

Other Countries: If you are located outside the United States or EU/EEA, these Terms shall be governed by the laws of the jurisdiction in which ColorRestore operates. However, mandatory consumer protection laws of your country of residence may apply and take precedence over certain provisions of these Terms, particularly regarding warranties, liability limitations, and dispute resolution.

International Users: By using the Service, you acknowledge that you are responsible for compliance with all local laws, regulations, and restrictions in your jurisdiction regarding the upload, processing, and use of images. ColorRestore makes no representation that the Service is available or appropriate for use in all jurisdictions.

Waiver of Class Actions and Jury Trials: To the extent permitted by applicable law, you waive any right to participate in a class action lawsuit or class-wide arbitration against ColorRestore. In jurisdictions where such waivers are not permitted, those provisions do not apply.

Indemnification

You agree to defend, indemnify, and hold harmless The Pixverse Co., ColorRestore, their affiliates, subsidiaries, parent companies, officers, directors, employees, agents, contractors, licensors, and service providers from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, debt, expenses (including but not limited to reasonable attorney's fees, court costs, and expert witness fees), and settlements arising from or related to:

  • Your use of the Service or any restored images
  • Your violation of these Terms or any applicable laws or regulations
  • Your violation of any third-party rights, including copyright, trademark, privacy, publicity, or other intellectual property rights
  • Your upload of images that you do not have the legal right to use, modify, or restore
  • Any claims that restored images created through our Service infringe upon third-party rights
  • Your use or distribution of restored images in violation of applicable laws or regulations
  • Any damage, loss, or claim resulting from your reliance on restoration results
  • Any breach of your representations, warranties, or covenants contained in these Terms
  • Any unauthorized access to or use of the Service through your account or credentials

This indemnification obligation will survive termination of these Terms and your use of the Service. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

Force Majeure

ColorRestore shall not be liable for any failure or delay in performance under these Terms that is due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, pandemics, or epidemics
  • War, terrorism, riots, or civil unrest
  • Government actions, regulations, or restrictions
  • Internet or telecommunications failures or outages
  • Third-party service provider failures (including payment processors, cloud services, or AI service providers)
  • Cyberattacks, data breaches, or security incidents
  • Labor strikes or work stoppages
  • Shortages of materials, equipment, or services

In the event of such circumstances, ColorRestore will make reasonable efforts to resume performance as soon as practicable, but shall not be liable for any damages resulting from such delays or failures.

Termination

We reserve the right to suspend, terminate, or refuse service to you, at our sole discretion, at any time and for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Upload of prohibited content or images you do not have rights to
  • Attempts to reverse engineer, hack, or exploit the Service
  • Non-payment or payment disputes
  • Any other reason we deem necessary to protect the Service or other users

Upon termination, your right to use the Service will immediately cease. You remain liable for all amounts due up to and including the date of termination. Sections of these Terms that by their nature should survive termination (including but not limited to indemnification, limitation of liability, and dispute resolution) will survive termination.

Severability and Miscellaneous

Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of The Pixverse Co.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Pixverse Co. regarding the Service and supersede all prior and contemporaneous written or oral agreements, understandings, or communications between you and The Pixverse Co. relating to the subject matter hereof.

Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without The Pixverse Co.'s prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. The Pixverse Co. may freely assign or transfer these Terms, or any rights or obligations hereunder, without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

Relationship of Parties: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and The Pixverse Co. You are an independent user of the Service, and no party has the authority to bind the other or to incur any obligation on the other's behalf.

Third-Party Beneficiaries: These Terms are for the sole benefit of the parties hereto and their permitted successors and assigns. Nothing herein, express or implied, is intended to or shall confer upon any other person or entity any legal or equitable right, benefit, or remedy of any nature whatsoever under or by reason of these Terms.

Export Control: You agree to comply with all applicable export and import laws, regulations, and restrictions. You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Prohibited Automated Access: You agree not to use any automated system, including but not limited to robots, spiders, scrapers, or similar technologies, to access, monitor, or copy any content from the Service without our prior written permission. You agree not to interfere with or disrupt the Service or servers or networks connected to the Service.

Electronic Communications: By using the Service, you consent to receive electronic communications from us. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

Modifications: We reserve the right to modify these Terms at any time. Material changes will be effective upon posting the updated Terms. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
